EPA adopted a Bureau of Indian Affairs (BIA) categorical exclusion (CATEX) for use for a single project under the Contaminated Alaska Native Claims Settlement Act (ANCSA) Lands Assistance Program for a waste management activity involving remediation of a hazardous waste site under the NEPA. This notice describes the categories of proposed actions for which EPA intends to use the BIA CATEX and describes the consultation between the agencies.
